MoC to Step Up Online Music Regulations

China's Ministry of Culture (MoC) plans to strengthen its checks into online music content, including problem areas in imported and pirated music, unlicensed links, market behavior and transactions, reports 163.com quoting a recent MoC notice. MoC's definition of online music includes songs, music videos and flash videos transmitted online or via mobile or fixed-lined networks, as well as direct links to music products.

According to the notice, companies importing online music must gain MoC approval as Internet culture companies, and only companies that have directly obtained broadcasting or licensing rights can apply for approval. Contracts to import online music, including from Macau, Hong Kong and Taiwan, must also gain MoC approval before the contract is considered valid. Imported music that is already broadcast online in China but has not been approved should be submitted to the MoC before December 31, 2009.

The MoC has developed an online registration system for online music operators, including an "expressway" to approve selected music products within three working days, the report said.
